Is it permissible to use a Single Phase NF Panelboard as a Single Phase subpanel if the source is 240/120V High Leg Delta?

Cause:
Have an upstream panelboard that is rated 240/120V Delta (High Leg) with a higher SCCR rating (35k and above) and wanting to feed single phase panels. The branch circuit breakers are not approved to series rate to the breaker upstream. The NF panel has branch circuit breakers that matches the required SCCR, need to know if a Single Phase NF Panelboard will work.
Resolution:
They can install a SINGLE PHASE NF panelboard downstream as long as the upstream breaker feeding the single phase NF is phased A & C ONLY. If an AB or BC phased breaker is used to feed the downstream single phase NF, they will have 208V phase to neutral instead of 120V.
